Mocha Messenger End User License Agreement

Effective date: April 29, 2026

This End User License Agreement ("EULA") is a legal agreement between you
and MochaChat Contributors ("Mocha," "we," "us," or "our") for the Mocha
Messenger software, Mocha Passport account service, Mocha Messenger Service,
related website properties, and any related updates, pre-release builds, or
accompanying materials we provide (collectively, the "Services").

By installing, copying, accessing, or using the Services, you agree to this
EULA. If you do not agree, do not install or use the Services.

1. PRE-RELEASE NOTICE

This build is a development build and pre-release software.

That means:
- features may be incomplete, changed, or removed without notice;
- bugs, crashes, compatibility issues, security issues, and data loss are
  possible;
- the Services may be interrupted, reset, or taken offline at any time; and
- you should not rely on this build for critical, business, production,
  emergency, or safety-related use.

2. LICENSE GRANT

Subject to this EULA, Mocha grants you a limited, revocable, non-exclusive,
non-transferable, non-sublicensable license to install and use the Services
for personal use, internal testing, evaluation, development feedback, and
other lawful use of the Mocha network.

You may make a reasonable number of backup copies solely for backup or
recovery.

3. OWNERSHIP

The Services are licensed, not sold. Mocha and its licensors retain all
rights, title, and interest in and to the Services, including software,
artwork, names, logos, protocols, site content, and all related intellectual
property rights, except for the limited license expressly granted in this
EULA.

4. ACCEPTABLE USE

You agree not to:
- use the Services in violation of applicable law or regulation;
- interfere with, disrupt, probe, overload, or bypass security of the
  Services;
- reverse engineer, decompile, or disassemble the Services except to the
  extent applicable law expressly permits it despite this restriction;
- use the Services to transmit malware, spam, fraudulent messages, or
  abusive, infringing, or unlawful content;
- impersonate another person or misrepresent your affiliation;
- attempt to access accounts, messages, files, or systems you are not
  authorized to access; or
- make unauthorized modifications to the client, protocol, or network
  traffic between the Mocha client and Mocha services, especially to evade
  rules, disrupt the network, or act with malicious intent; or
- use automated means to abuse registration, login, messaging, presence,
  contact, or file-transfer features.

5. ACCOUNTS AND CREDENTIALS

Some features require a Mocha Passport account. You are responsible for:
- providing accurate registration information;
- maintaining the confidentiality of your credentials;
- activity that occurs through your account; and
- notifying us through the official Discord server if you believe your
  account or credentials have been compromised.

Mocha may suspend, limit, or terminate access if we reasonably believe your
use violates this EULA, threatens users or infrastructure, or creates legal
or security risk.

Unauthorized modifications or tampering that affect traffic between the
Mocha client and server may result in temporary or permanent bans from the
Mocha service, especially when done with malicious intent.

6. COMMUNICATIONS, CONTACTS, ALERTS, AND FILES

The Services may let you:
- create and use a Mocha Passport account;
- maintain contacts, aliases, blocked users, and contact requests;
- publish presence and personal-message information;
- exchange real-time messages, typing notifications, and conversation
  invitations;
- start or receive voice and video conversations, including related
  call-control and media-relay traffic;
- receive activity alerts, service notices, and in-client update prompts;
  and
- send or receive files through the Messenger client.

You are responsible for the content you send, receive, or store locally
through the Services. Mocha does not claim ownership of your content, but you
grant Mocha the limited rights needed to host, route, process, secure, and
display that content solely to operate the Services.

You must not use the Services to send content you do not have the right to
send.

7. THIRD-PARTY SOFTWARE AND SERVICES

The installer for this build may download and install the Microsoft .NET 9
Desktop Runtime as a prerequisite. Microsoft software is licensed to you
under Microsoft's terms, not this EULA.

Mocha may also link to or rely on third-party services such as Discord or
third-party hosting and network infrastructure. Those services are governed
by their own terms and privacy policies.

8. UPDATES AND CHANGES

Mocha may release patches, updates, replacements, or entirely new builds at
any time. Some updates may be offered through the client itself and may be
marked as required for continued use of a specific pre-release build. We may
modify, suspend, or discontinue any part of the Services without notice,
especially during the pre-release period.

9. PRIVACY

Your use of the Services is also governed by the Mocha Messenger Privacy
Policy.

10. TERMINATION

This EULA remains in effect until terminated. It automatically terminates if
you fail to comply with it.

Mocha may suspend or terminate your access, or block specific uses, at any
time if needed to protect users, infrastructure, or legal compliance.

Upon termination, you must stop using the Services and delete all copies in
your possession or control, except to the extent applicable law requires
otherwise.

11. DISCLAIMERS

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED
"AS IS" AND "AS AVAILABLE," WITH ALL FAULTS.

MOCHA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY,
INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, AVAILABILITY,
AND THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Because this is pre-release software, you specifically accept the risk of
defects, outages, incompatibilities, and possible data loss.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOCHA AND ITS
CONTRIBUTORS, OPERATORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE
FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE
DAMAGES, OR FOR ANY LOSS OF DATA, FILES, PROFITS, REVENUE, GOODWILL,
BUSINESS, OR USE, ARISING OUT OF OR RELATING TO THE SERVICES OR THIS EULA,
EVEN IF ADVISED OF THE POSSIBILITY OF THOSE DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MOCHA'S TOTAL LIABILITY
ARISING OUT OF OR RELATING TO THE SERVICES OR THIS EULA WILL NOT EXCEED THE
GREATER OF:
- the amount you paid for the specific software or service giving rise to the
  claim; or
- ten U.S. dollars (USD $10.00).

Some jurisdictions do not allow certain limitations, so some of the above may
not apply to you.

13. FEEDBACK

If you submit suggestions, ideas, bug reports, or other feedback, you grant
Mocha a worldwide, non-exclusive, perpetual, irrevocable, sublicensable,
transferable, royalty-free license to use, copy, modify, distribute, and
otherwise exploit that feedback for any purpose without compensation or
obligation to you.

14. EXPORT AND LEGAL COMPLIANCE

You agree to comply with applicable import, export, sanctions, and trade laws
in connection with your use of the Services.
